Warranty Policy

1. Definitions

1.1 "Barrister & Bespoke," "we," "us," and "our" mean Barrister & Bespoke LLC, a Florida limited liability company with its principal place of business in Fort Myers Beach, Florida.

1.2 "Product" means an item purchased from barristerandbespoke.com.

1.3 "House Product" means a Product sold under the Barrister & Bespoke name: The Brief, The Docket, The Chambers, The Circuit, The Counsel, The Retainer, The Silk, and The Recess, and any Product we later designate as part of our own line.

1.4 "Curated Product" means a Product manufactured by a third party and selected by us for our collection, including goods from Korchmar, Time Resistance, Gallery Leather, Pelikan, S.T. Dupont, Esterbrook, Xikar, and Prestige Import Group.

1.5 "Delivery" means the date the carrier records delivery of the Product to you.

1.6 "Business Day" means Monday through Friday, excluding federal holidays.


2. Two kinds of warranty, stated plainly

Every Product we sell is covered by a written warranty. Who stands behind it depends on who made it.

House Products are warranted by Barrister & Bespoke directly, under the Limited Warranty in Section 3.

Curated Products are warranted by their manufacturers, under each manufacturer's own terms, summarized in Section 5 and stated in full on each product page. For the first thirty days, Barrister & Bespoke additionally stands behind every Curated Product itself, under Section 4.

Nothing in this policy limits your rights under our Returns & Exchanges Policy, which governs returns, exchanges, and Products that arrive damaged, defective, or not as ordered.


3. The Barrister & Bespoke Limited Warranty — House Products

3.1 What is covered

For five (5) years from Delivery, Barrister & Bespoke warrants each House Product against defects in materials and workmanship under normal use. This includes structural stitching that fails, hardware — zippers, clasps, buckles, locks, and rivets — that breaks or ceases to function, and leather that delaminates, cracks, or fails in a manner not attributable to wear or the causes excluded below.

3.2 What we will do

If a covered defect appears, we will repair the Product at no charge for parts or labor. If, in our judgment, repair is impracticable, we will replace the Product with the same Product or one of equivalent quality and value, at our option. Repair is the primary remedy; replacement is at our discretion. A repair or replacement under this warranty does not extend or restart the warranty period.

3.3 What is not covered

This warranty covers manufacturing defects. It does not cover:

(a) normal wear, including surface scratches, scuffs, edge wear, and the gradual softening of leather with use;

(b) the natural characteristics of full-grain leather — variations in tone and grain, small scars, veins, wrinkles, and the patina that develops over time. These are the marks of genuine leather, not defects;

(c) damage from misuse, accident, or neglect, including overloading a case beyond its intended capacity;

(d) damage from water, prolonged moisture, heat, fire, chemicals, cosmetics, solvents, or cleaning agents not intended for leather;

(e) damage resulting from improper storage;

(f) alteration or repair by anyone other than Barrister & Bespoke, including monogramming, embossing, or other personalization performed by a third party. We understand the appeal of a monogram; we simply cannot warrant work done by other hands, or damage arising from it;

(g) Products purchased from anyone other than Barrister & Bespoke.

3.4 Who is covered, and what you will need

This warranty extends to the original purchaser and to the recipient of a House Product purchased as a gift. A claim requires proof of purchase — the order number, or the order confirmation, is sufficient. This warranty is not otherwise transferable.

3.5 How to make a claim

Write to sales@barristerandbespoke.com with your order number, a description of the issue, and photographs of the Product and the affected area. We respond within one (1) Business Day. If the claim requires inspection, we will provide the shipping address and instructions. You are responsible for the cost of shipping the Product to us; we recommend a tracked service. If the defect is covered, we pay the return shipping to you.

3.6 Implied warranties and your legal rights

Any implied warranties on a House Product, including the implied warranties of merchantability and fitness for a particular purpose, are limited in duration to the five-year term of this written warranty. Some states do not allow limitations on how long an implied warranty lasts, so the above limitation may not apply to you. This warranty gives you specific legal rights, and you may also have other rights which vary from state to state.


4. The Thirty-Day Assurance — Curated Products

Independent of any manufacturer's warranty, Barrister & Bespoke makes its own commitment on every Curated Product it sells: for thirty (30) days from Delivery, if a Curated Product fails in ordinary use, we will replace it or refund it in full, at your election, directly. You are not required to contact the manufacturer first, and our commitment does not depend on the manufacturer's terms, timelines, or exclusions. We then pursue our own recovery from the manufacturer; that is our concern, not yours.

This Assurance is a limited warranty within the meaning of federal law. It covers failure in ordinary use; it does not cover the exclusions listed in Section 3.3(a) through (g), which apply equally here.

After the thirtieth day, a Curated Product is covered by its manufacturer's warranty, described in Section 5.


5. Manufacturer warranties — Curated Products

5.1 How these warranties work

Each Curated Product carries its manufacturer's own written warranty. The manufacturer — not Barrister & Bespoke — is the warrantor, sets the terms, and performs the remedy. We state each manufacturer's terms accurately, make them available on every product page before purchase, and will help you identify and reach the right manufacturer if a claim arises. After the thirtieth day from Delivery, the manufacturer's warranty is the governing warranty on a Curated Product, and claims go directly to the manufacturer as shown below.

5.2 Summary of manufacturer warranties

5.3 Notes worth knowing before a claim

Shipping for manufacturer claims. Unless a manufacturer states otherwise, the cost and risk of shipping a Product to the manufacturer for warranty service is the customer's; Pelikan, for example, recommends insuring the shipment. This differs from Section 3.5 and Section 4, where our own terms govern.

Prestige's three-day transit-damage window. Prestige Import Group requires that damage in transit be reported to Prestige within three (3) Business Days of delivery. We state it here because we set out each manufacturer's terms accurately, not because it asks anything of you. It governs shipments Prestige itself makes, and it does not shorten any period you have with us. If a Product reaches you damaged, your rights are under our Returns & Exchanges Policy and, for thirty days, under the Thirty-Day Assurance in Section 4 — which applies whatever a manufacturer's own timeline may be. Meeting Prestige's window is our task, not yours.

Lighters and air travel. Torch and jet lighters may not be carried aboard aircraft in carry-on or checked baggage, fueled or unfueled, and will be confiscated. No manufacturer's warranty covers a confiscated lighter.

Lighters ship unfueled. Every butane lighter we sell ships without fuel, as air-freight regulations require. A new lighter that does not light has not failed; it needs butane.

Humidors and seasoning. A wood humidor must be seasoned before use, following the manufacturer's instructions. Cracking or warping caused by improper seasoning is not a manufacturing defect under any manufacturer's terms, or under Section 4.

Consumables. Butane, humidification solution, humidity packets, ink, and similar consumables are not covered by any warranty in this policy.


6. Purchases by firms

The warranties in this policy apply equally to purchases made by firms, companies, and organizations, including purchases through our For Firms channel. A firm's purchase receives the same warranty as an individual's. Terms specific to firm orders — pricing, ordering, and fulfillment — are stated in the Terms of Sale for Firms and do not alter the warranties here.


7. General terms

7.1 This policy is governed by the laws of the State of Florida. Venue for any dispute lies in Lee County, Florida. Nothing in this section limits rights you hold under the law of your own state that cannot be limited by agreement.

7.2 To the extent permitted by law, our liability under this policy is limited to the repair, replacement, or refund remedies stated here. Some states do not allow the exclusion or limitation of incidental or consequential damages, so this limitation may not apply to you.

7.3 If any provision of this policy is held unenforceable, the remainder continues in effect.
